MINUTES OF THE CUSTER COUNTY BOARD OF SUPERVISORS

June 26, 2012

The Custer County Board of Supervisors met in regular session, on Tuesday, June 26, 2012 in the boardroom of the Custer County Courthouse. Chairman Hickenbottom called the meeting to order at 9:00 a.m. and reported the Open Meeting Laws are posted on the south wall. The following board members were present, Hickenbottom, Haynes, Olson, McCullough, Hodson, Varney, Lichtenberger, and Constance Gracey, Custer County Clerk.

C. Jacobsen presented this application:

Motion by McCullough, 2^nd Lichtenberger, to approve an application for V & T Farms LLC, to go underground with 1 ½” water pipe, northeast of M.C. Roll call vote. Ayes-all Nays-none

Motion by Haynes, 2^nd Hodson, to follow the road committees recommendation of grinding the existing, reworking the sub base, then resurfacing both these segments of road, but currently to grind and air-out the road base west of Wright’s on the Paulsen Road to the intersection of Cramer Canyon road and then south to just north of Ross’s on the Cramer Canyon Road. The road north from the intersection of the Cramer Canyon and Paulsen road’s is to be converted from asphalt surface to gravel, and all of this will be added to the One Year Plan. Roll call vote. Ayes-all Nays-none

Jacobsen also discussed the BNSF Rail crossing approx.. 1.5 miles SE of Anselmo(#83/#1443 Rd, @DOT Crossing 064620R) presently being considered for use by the new grain facility under construction by Anderson Group. After much discussion, the Co. Board directed the Co. Attorney to review the information and advise the Co. Board on how to address this railroad crossing.

Motion by Olson, 2^nd Lichtenberger, to approve by Res. #34R-2012, to Amend the Custer County One Year Plan for part of Road #83/#1443, Victoria Township road according to the requirements of the Board of Public Road Classifications and Standards. Roll call vote. Ayes-Olson, Lichtenberger, Haynes, McCullough, Varney Nays-Hodson

Motion by McCullough, 2^nd Lichtenberger, to approve Res. #33-2012, to declare county property as surplus property as listed. Roll call vote. Ayes-all Nays-none

Motion by Haynes, 2^nd Varney, to approve Amendment One for NE Dept of HHS of Children and Family Services Child Support Enforcement and Custer County for the term to extend from June 30,2012 to Sept. 30, 2012. Roll call vote. Ayes-all Nays-none

Motion by McCullough, 2^nd Olson, to set the rate for the Oconto tower @$3.00 per foot and to be paid yearly Roll call vote. Ayes-all Nays-none
